A lawyer for Phillip Fulmer says the Tennessee football coach will fight a subpoena seeking his sworn testimony in a suit filed by a former Alabama booster.
Attorney Jeff Hagood said he will seek to have the subpoena dismissed in Jackson County, AL where it was issued last week.
Fulmer was served with the subpoena at the SEC Media Days in suburban Birmingham, creating a stir at the league’s fall kickoff event.
Lawyers for former Crimson Tide booster Wendell Smith want Fulmer to testify in Smith’s lawsuit over an NCAA probe of the Alabama football program.
It concluded that Smith gave money to an Alabama prospect. Smith claims the NCAA defamed him in its report.
Hagood said he is fairly certain Fulmer has never met Smith.

If Fulmer has nothing to hide then why doesn’t he just answer the subpoena and appear in court and let the dice fall where they may after giving his testimony ? It seems to me the college football system and the actions of the boosters have a lot to do with what’s inherently wrong with the game.
Especially when the likes of the NCAA and college programs abound as well as the coaches are making millions of the backs of the so called student athletes . Why not just call ‘em indentured slaves for want of a better word ?
And on to another subject . Is Joe Pa awake or not ? Does he not realize what’s going on with his players ? Or to his mind is it just another vast conspiracy theory on the part of the press ? That’s another two off his team and makes in excess of over 30 so far that’ve been in trouble with the law. They’re beginning to make the Bungles look all too pristine.
