Denise Milani Lawsuit Against Periscope Entertainment Dismissed

The lawsuit filed by Denise Milani, real name Denise Trlica, against Periscope Entertainment was dismissed in January according to court records.

Milani originally filed suit in March 2010 alleging that photographer Matt Vantuch, Ishka Villcisneros, Vantuch’s personal assistant, and their company Periscope Entertainment, Inc. unlawfully and maliciously took control of her Web site, DeniseMilani.com, her Web site’s online store, and her MySpace, Facebook and Twitter accounts.

Milani retained the law firm of Beitchman & Zekian, PC, which filed the Complaint in the Los Angeles Superior Court. In June 2010, Milani’s attorney successfully argued that an injunction against Periscope Entertainment was warranted.

In July 2010, Brett S. Markson, attorney for Periscope Entertainment, filed a cross complaint against Milani and the case was then assigned to a court appointed mediator.

In October 2010, attorneys for Milani and Periscope Entertainment declined to participate in court appointed mediation and agreed to private mediation.

There were no further filings with the court until January 19 of this year when the case against Periscope Entertainment was dismissed with prejudice.

Within civil legal matters, when a case is dismissed with prejudice the plaintiff is barred from filing another case on the same claim.

Dismissal with prejudice is a final judgment and the case becomes res judicata, meaning the case can’t be argued again and is not subject to appeal.
