Lester Munson is one of the preeminent voices in sports law and he’s written an article about a pending NLRB decision and its potential effects on the NBA lockout.
The National Labor Relations Board could reach a decision in the very near future involving a case of unfair labor practices filed by NBA players.
The players claim that NBA owners purposely stalled negotiations for a new collective bargaining agreement over the past year.
Munson writes that in order for the players to prevail, they will have had to show that the owners were “deliberately scheming to initiate their lockout at the earliest possible moment and are exaggerating their financial plight.”
The NLRB decision could produce a dramatic change in bargaining leverage.
The outcome raises significant questions about the status of collective bargaining negotiations between the players and owners and the 2011-12 NBA season.
